1. Acceptance of Terms & Legal Binding Agreement
Agreement: By creating an account, browsing aakadimia.com, purchasing any course, enrolling in live classes, utilizing virtual practical labs, or offering tutoring services on Aakadimia, you ("User", "Student", "Parent/Guardian", or "Tutor") enter into a legally binding contract with Aakadimia and its parent entity Bongalo 24 Co Ltd ("Company", "Platform", "We", "Us", or "Our").
Acceptance: If you do not unconditionally agree to every provision in these Master Terms and Conditions, you are strictly prohibited from accessing or using the Platform.
Age Requirement & Parental Authorization: Users under eighteen (18) years of age must have explicit authorization and supervision from a parent or legal guardian. The parent or legal guardian assumes full financial and legal responsibility for all account activity.
2. Platform Identity & Service Scope
Educational Marketplace & Live Learning Platform: Aakadimia provides structured academic exam
preparation (including IELTS, PTE,TOEIC,TOEFL,DELF,DALF,TCF,TEF, DFP, WAEC, and GCE O/A Levels), industry IT certifications (including CompTIA, Cisco, AWS,AI Certification and Microsoft), and professional development courses delivered via live interactive classes, virtual labs, and digital learning assets.
* Verified Educator Quality Standard: All instructors hosted on the Platform undergo identity verification, credential checks, and mandatory pedagogical training (Aakadimia Certified Educator Course).
No Guarantee of External Results: While Aakadimia incorporates senior official examiners (15+ years marking experience) and certified IT professionals, the Company does not guarantee specific exam scores, grades, university admissions, employment, or salary levels. Final outcomes depend strictly on individual student effort and external examining body evaluations.
3. Account Registration, Security & Anti-Fraud
Accuracy of Data: Users must provide complete, accurate, and current legal names, contact numbers, and payment details during registration.
Account Non-Transferability: User accounts, login credentials, one-time passwords (OTPs), and course access links are strictly personal and non-transferable.
Prohibited Account Sharing: Concurrent logins or sharing access with non-registered individuals is prohibited. The Platform employs automated system monitoring to detect simultaneous logins or IP anomalies. Detected account sharing will result in immediate termination without refund.
4. Student Conduct, Code of Ethics & Prohibited Actions
To protect our learning environment, all students and platform visitors must adhere to strict behavioral rules.
Strictly Prohibited Behaviors:
Academic Malpractice: Submitting fraudulent work, employing unauthorized AI tools during live evaluations, or forging certificate credentials.
Harassment & Hate Speech: Bullying, vulgarity, or discrimination based on race, gender, religion, or performance level directed toward tutors, staff, or peers.
Intellectual Property Theft: Recording, screen-capturing, ripping, downloading, or redistributing live class streams, practical lab files, audio files, or instructor slides outside aakadimia.com.
Off-Platform Payment Solicitation: Attempting to arrange private offline tutoring or sending direct payments to Aakadimia instructors outside official platform payment gateways.
Cyber Security Violations: Transmitting malware, reverse-engineering practical lab infrastructure, or attempting to breach server security.
5. Tutor Terms, Financial Wallet, KYC & Revenue Split
Instructors and Tutors operating on Aakadimia are independent contractors governed by these additional terms:
Integrated Tutor Wallet: All gross revenues generated from course sales, student enrollments, and live class bookings attributed to a Tutor are recorded in the Tutor’s digital wallet dashboard.
Revenue Share Split (67% / 33%):
Tutor Allocation (67%): The Tutor receives sixty-seven percent (67%) of net gross revenues generated from their course sales and live class bookings.
Platform Fee (33%): Aakadimia retains thirty-three percent (33%) of generated revenue to cover platform hosting, Mobile Money gateway fees, practical virtual lab maintenance, operations, and marketing.
Mandatory Pedagogy Certification ($20 USD): Prior to hosting paid courses or live classes, Tutors must complete the Aakadimia Certified Educator Course and pay a non-refundable $20 USD fee (or local currency equivalent) covering pedagogical evaluation and credential issuance.
International AML & KYC Compliance: Tutors must complete full Know Your Customer (KYC) verification submitting a valid government photo ID, proof of address, and live selfie—before receiving payouts. Aakadimia complies with international Anti-Money Laundering (AML) standards and reserves the right to freeze wallets and report suspicious financial transactions to relevant authorities.
Off-Platform Solicitation Penalty: Directing students to pay outside Aakadimia (e.g., via personal Mobile Money accounts) results in immediate account termination, course removal, and total forfeiture of accumulated wallet balances.
6. Financial Terms, Pricing & Mobile Money Payments
Multi-Currency Processing: Aakadimia supports local and international payment methods, including Mobile Money (MTN MoMo, Orange Money, M-Pesa, Airtel Money), Bank Transfers, and Credit/Debit Cards.
Installment Payment Terms: Where installment plans are permitted, failure to settle scheduled Mobile Money payments within seven (7) days of the due date will suspend access to live classes, virtual labs, and course recordings until settled.
7. Comprehensive Refund, Cancellation & Grievance Policy
Refund Eligibility Matrix:
Live Exam Prep (IELTS, PTE,TOEIC,TOEFL,DELF,DALF,TCF,TEF, DFP, WAEC, and GCE O/A Levels): Full refund available if requested in writing within forty-eight (48) hours of purchase AND prior to attending the second (2nd) live class.
IT Certifications (CompTIA / Cisco / AWS / Microsoft, AI Certifications): Partial refund (minus a 15% virtual lab provisioning fee) available within seven (7) days of purchase, provided practical lab credentials remain unused.
Non-Refundable Circumstances:
Attending two (2) or more live classes.
Personal internet blackouts, data depletion, power outages, or failure to meet hardware requirements (low-data class recordings and notes are provided as a standard backup).
Unsatisfactory performance in an official external examination (e.g., IELTS, WAEC, or AWS certification exams).
Accounts suspended or terminated due to policy breaches or harassment.
Grievance Resolution Escalation:
Step 1: Submit a formal ticket to info@aakadimia.com within seven (7) days of the issue.
Step 2: Academic Operations investigates and responds within five (5) business days with a remedy (session replacement, lab extension, credit, or refund).
Step 3: Final executive appeal to appeals@aakadimia.com for review by Bongalo 24 Co Ltd. The executive ruling is final and binding.
8. Absolute Account Suspension, Freeze & Termination Rules
Aakadimia reserve the right to suspend, freeze, or permanently ban any user account without prior notice under these conditions:
Immediate Termination (No Refund / Wallet Forfeiture): Payment fraud, submission of fake KYC documents, harassment, academic piracy, off-platform payment solicitation, or cyber abuse.
Temporary Suspension: Investigation of unresolved student complaints, billing discrepancies, or minor classroom disruptions.
9. Comprehensive Legal Protection & Liability Disclaimers
9.1 Intellectual Property Ownership
All software code, UI designs, trademarks, logos, video assets, virtual lab architectures, and documentation on aakadimia.com are the exclusive property of Bongalo 24 Co Ltd. Tutors retain copyright of original materials but grant Aakadimia a worldwide, royalty-free, non-exclusive license to host, stream, display, and promote such content.
9.2 Indemnification
Users and Tutors agree to defend, indemnify, and hold harmless Aakadimia, Bongalo 24 Co Ltd, its officers, directors, employees, and agents from any claims, damages, liabilities, losses, or legal costs (including attorney fees) arising from:
Breach of these Terms or Staff/Student Policies.
Copyright or intellectual property infringement within uploaded content.
Personal conduct during live sessions or student-tutor interactions.
9.3 Limitation of Liability & Force Majeure
To the maximum extent permitted by law, Aakadimia and Bongalo 24 Co Ltd shall not be liable for indirect, special, incidental, or consequential damages—including loss of profits, data, or career opportunities.
Aakadimia is not liable for service delays or failures caused by events beyond reasonable control (Force Majeure), including national power blackouts, undersea telecommunication cable cuts, ISP downtime, or government internet restrictions.
Maximum Liability Cap: The total cumulative monetary liability of Aakadimia to any user shall not exceed the total fees paid by that user to Aakadimia in the three (3) months preceding the claim.
9.4 Governing Law & Binding Arbitration
This Agreement is governed by the commercial and civil laws applicable to Bongalo 24 Co Ltd's jurisdiction of incorporation. Any unresolved dispute shall first undergo mandatory good-faith negotiation (30 days), followed by binding commercial arbitration under recognized regional rules prior to resorting to court litigation.
10. Modifications to Terms
Aakadimia reserves the right to modify or update these Terms and Conditions at any time. Continued use of the website or services following posted updates constitutes full acceptance of the revised Terms.
